The family of a man who died in a fatal crash while using Tesla’s Autopilot system has filed a lawsuit against the electric vehicle manufacturer, accusing the company of “fraudulent misrepresentation” and misleading the public about the safety of its autonomous driving technology.
The lawsuit, filed in California federal court, claims that Tesla misled consumers about the capabilities and safety of its Autopilot system, which is marketed as an advanced driver assistance feature that can safely handle many driving tasks without human intervention. The family argues that Tesla’s claims about the system’s reliability were deceptive and contributed directly to the death of their loved one, who was behind the wheel of a Tesla Model 3 when the crash occurred.
“This tragic loss is the result of Tesla’s dangerous and reckless claims about the capabilities of their Autopilot system,” said the family’s attorney, Lisa Grant. “Tesla has downplayed the risks of their technology and, in doing so, has put lives at risk. Our client’s family deserves justice and accountability for the misleading promises Tesla made regarding the safety of their product.”
The Fatal Incident
The fatal incident occurred in early 2023, when the deceased, identified as 38-year-old Brian Foster, was driving his Tesla Model 3 on a highway in Southern California. According to the lawsuit, Foster had engaged the Autopilot feature, which was designed to steer, accelerate, and brake the vehicle under certain conditions, while he was driving on a clear, straight stretch of road.

However, Tesla’s Autopilot system failed to recognize an obstruction in the roadway, leading to a collision with a stationary vehicle that had been involved in an earlier accident. Foster, who had been found wearing his seatbelt and appeared to be paying attention to the road, died on impact.
An investigation by the National Highway Traffic Safety Administration (NHTSA) later confirmed that the Tesla’s Autopilot system had been active at the time of the crash, but was unable to avoid the collision.
